1) Scope of application
This website is provided by Schaerer AG, Niedermattstrasse 3b, P.O. Box 336, 4528 Zuchwil, Switzerland, e-mail: info@schaerer.com (hereinafter "Schaerer") as the controller within the meaning of the Data Protection Act ("DPA") and the EU General Data Protection Regulation ("GDPR"). The processing of your data is subject to the DPA. If necessary, the GDPR may also apply in individual cases, which is why reference is made to it in detail below. You can reach our data protection officer via our contact form under "Request to the data protection officer" or our postal address with the addition "the data protection officer".
2) Requirements for the transfer of personal data to third countries
As part of our business relationships, your personal data may be passed on or disclosed to third-party companies. These may also be located outside the European Economic Area (EEA), i.e. in third countries. Such processing is carried out exclusively for the fulfillment of contractual and business obligations and to maintain your business relationship with us (legal basis is Art. 6 para. 1 lit. b or lit. f in each case in conjunction with. Art. 44 ff. GDPR). We will inform you about the respective details of the transfer at the relevant points below.
The European Commission certifies that some third countries have data protection standards comparable to the EEA standard by means of so-called adequacy decisions (a list of these countries and a copy of the adequacy decisions can be found here: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_en). However, in other third countries to which personal data may be transferred, there may not be a consistently high level of data protection due to a lack of legal provisions. If this is the case, we ensure that data protection is adequately guaranteed. Please contact our data protection officer if you would like more information on this.
3) No obligation to provide personal data
We do not make the conclusion of contracts with us dependent on you providing us with personal data beforehand. As a customer, you are under no legal or contractual obligation to provide us with your personal data; however, we may only be able to provide certain services to a limited extent or not at all if you do not provide the necessary data. If this should exceptionally be the case in the context of the products offered by us and presented below, you will be informed of this separately.
4) Legal obligation to transfer certain data
Under certain circumstances, we may be subject to a specific legal or statutory obligation to provide the lawfully processed personal data to third parties, in particular public authorities (Art. 6 para. 1 sentence 1 lit. c GDPR).
5) Your rights
a) Right to information
You can request information in accordance with Art. 15 GDPR about your personal data that we process.
b) Right to object
You have the right to object for specific reasons. You have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on point (f) of Article 6(1) GDPR. The controller will then no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims. The collection of data for the provision of the website and the storage of log files are absolutely necessary for the operation of the website.
c) Right to rectification
If the information concerning you is not (or no longer) correct, you can request a correction in accordance with Art. 16 GDPR. If your data is incomplete, you can request that it be completed.
d) Right to erasure
You can request the erasure of your personal data in accordance with Art. 17 GDPR.
e) Right to restriction of processing
In accordance with Art. 18 GDPR, you have the right to request that the processing of your personal data be restricted.
f) Right to lodge a complaint
If you believe that the processing of your personal data violates data protection law, you have the right to lodge a complaint with a data protection supervisory authority of your choice in accordance with Art. 77 (1) GDPR. This also includes the data protection supervisory authority responsible for the controller Landesbeauftragter für Datenschutz und Informationsfreiheit Baden-Württemberg, Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg, Lautenschlagerstraße 20 70173.
g) Right to data portability
In the event that the requirements of Art. 20 para. 1 GDPR are met, you have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to third parties. The collection of data for the provision of the website and the storage of log files are absolutely necessary for the operation of the website. They are therefore not based on consent pursuant to Art. 6(1)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR, but are justified pursuant to Art. 6(1)(f) GDPR. The requirements of Art. 20 (1) GDPR are therefore not met in this respect.
6) Data security
We use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties (e.g. TLS encryption for our website), taking into account the state of the art, the implementation costs and the nature, scope, context and purpose of the processing as well as the existing risks of a data breach (including its probability and impact) for the data subject. Our security measures are continuously improved in line with technological developments.
We will be happy to provide you with more detailed information on request. Please contact our data protection officer.
